Terms and Conditions
Last updated: October 2026
1. Scope and provider
These General Terms and Conditions (GTC) govern the use of the reservation service on www.maley.ch and subsequent purchases in our store.
The provider and contracting party is:
Studio maley GmbH
Zurlindenstrasse 57
8003 Zurich
Switzerland
Company ID (UID): CHE-325.613.640
Email: shop@maley.ch
Hereinafter referred to as “MALEY”, “we” or “us”. By using the reservation service, you accept these GTC.
2. Reservation model: no online purchase of objects
MALEY does not operate an online payment or ordering system for the sale of objects. Through our website, you can reserve selected objects on a non-binding basis, then view them in our store and, if you wish, purchase and pay for them there.
Please note:
- The presentation of objects on our website does not constitute a legally binding offer of sale. It is an invitation to make a reservation.
- A reservation creates neither a purchase contract nor an obligation to pay.
- A purchase contract is concluded only in our store, when you purchase the object and pay the purchase price there.
Workshop bookings are an exception. They are booked on a binding basis through our website and paid for online immediately. The provisions in section 10 apply.
3. Reservation process
You select an object on our website and send us the required details using the reservation form, usually your name, email address, possibly your telephone number, and details of the object you wish to reserve.
Once we receive your reservation, we send you a confirmation that we are holding the object for collection. This is a reservation confirmation and does not constitute a purchase contract.
4. Non-binding nature of the reservation
Your reservation is non-binding. You are not obliged to purchase the reserved object. If you decide against purchasing it when you visit the store, no charges or obligations arise.
The reservation does not create an obligation for MALEY to supply the object either. If a reserved object unexpectedly becomes unavailable, for example because of limited quantities or an inventory error, we will inform you and the reservation will lapse without further claims.
5. Reservation period and expiry
Reserved objects can be collected from our store once it has opened. Reservations made before the opening are held until the store opens.
We hold the object for collection for seven days from the time collection becomes possible. During normal store operations, this period begins with the reservation confirmation. For reservations made before the opening, it begins when we notify you that the object is ready for collection.
If you do not collect and pay for the object within this period, the reservation expires automatically without further notice. The object is then made available for sale again.
On request, we may extend a reservation if the object is still available. There is no entitlement to an extension.
6. Non-collection
If you do not collect a reserved object within the reservation period, no charges or obligations arise. The reservation expires in accordance with section 5. Please let us know if you no longer wish to take up a reservation, so that we can offer the object to other customers.
7. Prices and availability
All prices are in Swiss francs (CHF) and include statutory value added tax where applicable.
The price displayed or stated in our store at the time of purchase applies. We endeavour to keep the information on our website accurate and up to date. However, errors, pricing and display mistakes, and subsequent changes remain possible.
The availability shown on our website is non-binding. As some objects are available only in limited quantities, an object may no longer be available even if the website shows otherwise.
8. Purchase contract and payment in the store
A purchase contract is concluded only when you purchase the object in our store. Payment is made there using the accepted payment methods: cash, debit or credit card, and TWINT.
Shipping and home delivery are currently unavailable. Reserved objects are handed over exclusively in our store.
9. Transfer of ownership
Ownership of the object passes to you once the purchase price has been paid in full in our store.
10. Workshops
Booking and payment
Workshop bookings are binding. The full workshop fee is due immediately when you book. Unlike the reservation model for objects described in section 2, workshops are booked on a binding basis through our website and paid for online immediately. Your place is secured only once full payment has been received.
Cancellation by participants
You must cancel by emailing MALEY at shop@maley.ch. The time we receive your cancellation determines which refund applies:
- At least 14 days before the workshop starts: a full refund of the workshop fee.
- Less than 14 days, but at least seven days before the workshop starts: a refund of 50% of the workshop fee.
- Less than seven days before the workshop starts, or if you do not attend: no refund.
These periods are calculated backwards from the announced start time of the workshop. One day means 24 hours. The terms apply regardless of when you book, including last-minute bookings. Non-payment does not constitute cancellation.
Participation and suitability
Participants are responsible for assessing their own suitability to take part, for example in relation to allergies or sensitivity to scents.
Filling a cancelled place
If MALEY can fill your cancelled place at the same workshop price and receives payment from the new participant, your workshop fee will be refunded in full. Any partial refund already made will be taken into account. MALEY is under no obligation to fill the cancelled place.
Transferring your place
You may transfer your place to another person free of charge, provided they meet the participation requirements stated in the workshop description. You must email MALEY the replacement participant’s name before the workshop starts. MALEY does not issue a refund for a transfer. Any financial settlement is arranged directly between the people concerned.
Cancellation or postponement by MALEY
MALEY may cancel or postpone a workshop, particularly if there are too few participants or the workshop leader is unavailable. Registered participants will be informed as early as possible. If a workshop is cancelled, the workshop fee already paid will be refunded in full. If it is postponed, participants may choose between attending on the replacement date and receiving a full refund. A booking will only be transferred to another date, or a voucher issued, with the participant’s agreement. Further claims, particularly for travel or consequential costs, are excluded to the extent permitted by law.
Workshop arrangements
Unless otherwise stated, all workshops take place at MALEY, Zurlindenstrasse 57, 8003 Zurich. For organisational reasons, we may adjust the content, duration or workshop leader, provided the character of the workshop is maintained.
11. Warranty
The statutory warranty provisions of the Swiss Code of Obligations (CO) apply to objects purchased in our store. Please inspect the object when you purchase it. If you find a defect, contact us at shop@maley.ch so that we can find a solution.
For handcrafted objects, natural variations in colour, grain, texture and form are inherent to the material. They do not constitute defects, but are an expression of the craftsmanship involved.
12. Liability
We are liable in accordance with the statutory provisions. To the extent permitted by law, our liability for slight negligence is excluded. In particular, liability for indirect and consequential damage is excluded to the extent permitted by law. Liability for personal injury and for damage caused by intent or gross negligence is not excluded.
We assume no responsibility for the content of external websites to which we link.
13. Data protection
We process your personal data as part of the reservation and booking process in accordance with our Privacy Policy, which forms an integral part of these GTC.
14. Changes to these GTC
We may amend these GTC at any time. Each reservation or workshop booking is subject to the version published on our website at the time of that reservation or booking.
15. Applicable law and jurisdiction
The relationship between you and MALEY, and these GTC, are governed exclusively by Swiss law. The provisions of private international law and the United Nations Convention on Contracts for the International Sale of Goods (CISG) are excluded.
The exclusive place of jurisdiction is Zurich, Switzerland, unless mandatory statutory provisions provide otherwise.
16. Severability
If any provision of these GTC is or becomes wholly or partly invalid, the remaining provisions remain valid. The invalid provision will be replaced by a provision that comes as close as possible to its economic purpose.
