1. Scope and Provider
These General Terms and Conditions (GTC) govern the use of the reservation service on the website www.maley.ch and the subsequent purchase in the store.

Hereinafter "MALEY", "we", or "us". By using the reservation service, you accept these GTC.
2. Reservation Model – No Online Purchase
MALEY does not operate an online payment or ordering system. Through our website, you can reserve selected objects on a non-binding basis and then view, purchase, and pay for them in the store if you wish.
Please note:
- The presentation of objects on our website does not constitute a legally binding offer of sale, but rather an invitation for you to place a reservation.
- A reservation does not create a purchase contract or any obligation to pay.
- A purchase contract is concluded exclusively in the store, when you purchase the object and pay the purchase price on site.
3. Reservation Process
You select an object on our website and provide us with the required information via the reservation form (typically name, email address, possibly phone number, and the desired object).
After we receive your reservation, you will receive a confirmation that we are holding the object for you for collection. This confirmation is a reservation confirmation and not a purchase contract.
4. Non-Binding Nature of the Reservation
The reservation is non-binding for you. You are not obliged to purchase the reserved object. If you decide against the purchase in the store, no costs arise for you.
Likewise, the reservation does not create any obligation to supply on MALEY's part. Should a reserved object unexpectedly no longer be available (e.g. due to limited quantities or an error in inventory management), we will inform you and the reservation lapses without any further claims.
5. Reservation Period and Expiry
Reserved objects can be collected in the store once it has opened. Reservations received before the opening will be held for you until the opening.
From the point at which collection is possible – for an operating store from the reservation confirmation, and for reservations made before the opening from our notice that the object is ready for collection – we hold the object for collection for 7 days.
If you do not collect and pay for the object within this period, the reservation expires automatically and without further notice. The object is then released for sale again.
On request, we may extend a reservation, provided the object is still available. There is no entitlement to an extension.
6. Non-Collection
If you do not collect a reserved object within the reservation period, no costs or obligations arise for you. The reservation expires in accordance with Section 5. We kindly ask you to let us know if you no longer wish to take up a reservation, so that we can offer the object to other interested parties.
7. Prices and Availability
All prices are in Swiss francs (CHF) and, where applicable, include statutory value added tax.
The decisive price is the one displayed or stated in the store at the time of purchase. We endeavour to keep the information on our website current and accurate. However, errors, pricing and display mistakes, and intervening changes remain reserved.
The availability shown on the website is non-binding. As individual objects are available only in limited quantities, it may happen that an object is no longer available despite being shown on the website.
8. Purchase Contract and Payment in the Store
The purchase contract is only concluded in the store, when you purchase the object. Payment is made on site using the payment methods accepted in the store (cash, debit/credit card, TWINT).
Shipping and home delivery are currently not available. Reserved objects are handed over exclusively in the store.
9. Transfer of Ownership
Ownership of the object passes to you upon full payment of the purchase price in the store.
10. Warranty
The statutory warranty provisions under the Swiss Code of Obligations (CO) apply to objects purchased in the store. Please inspect the object at the time of purchase. If an object shows a defect, contact us at shop@maley.ch so that we can find a solution.
For handcrafted objects, natural variations in colour, grain, texture, and form are inherent to the material and do not constitute a defect, but are an expression of the craftsmanship involved.
11. Liability
We are liable in accordance with the statutory provisions. To the extent permitted by law, our liability for slight negligence is excluded. Excluded – to the extent permitted by law – is in particular liability for indirect and consequential damages. Liability for personal injury and for damages based on gross negligence or intent is not excluded.
We assume no responsibility for the content of external websites to which we link.
12. Data Protection
We process your personal data as part of the reservation process in accordance with our Privacy Policy, which forms an integral part of these GTC.
13. Changes to the GTC
We may amend these GTC at any time. The version published on our website at the time of the reservation applies to each reservation.
14. Applicable Law and Place of Jurisdiction
The relationship between you and MALEY, as well as these GTC, is governed exclusively by Swiss law, excluding the provisions of private international law and the UN Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction is Zurich, Switzerland, unless mandatory statutory provisions provide for another place of jurisdiction.
15. Severability Clause
Should individual provisions of these GTC be or become wholly or partially invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a provision that comes as close as possible to the economic purpose of the invalid provision.
